Terms and Conditions for Radical Recovery & Performance

Welcome to Radical Recovery & Performance (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website at https://radicalrecoverypt.com/ (the “Site”) and any services, including physical therapy, fitness training, or related offerings (collectively, the “Services”), provided by Radical Recovery & Performance. By accessing the Site or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use the Site or Services.
1. Acceptance of Terms
By accessing or using the Site or Services, you confirm that you are at least 18 years old (or have parental consent if under 18) and have the legal capacity to enter into these Terms. You also agree to comply with all applicable laws and regulations. We may update these Terms from time to time, and changes will be posted on the Site with an updated effective date. Your continued use of the Site or Services after such changes constitutes acceptance of the revised Terms.
2. Use of the Site and Services
a. Permitted Use
You may use the Site to learn about our Services, schedule appointments, contact us, or access resources we provide. Services, such as physical therapy or fitness training, are available to clients who meet eligibility requirements and comply with these Terms.
b. Prohibited Use
You agree not to:

c. Accounts

3. Services and Appointments
a. Eligibility
Our Services, including physical therapy and performance training, are provided to eligible clients based on professional assessment, medical history, and applicable laws. We reserve the right to decline or discontinue Services if deemed necessary for health, safety, or legal reasons.
b. Appointments
Appointments can be scheduled through the Site, by phone at (480) 687-7535, or via email at elisa@radicalrecoverypt.com.
You agree to provide accurate information when scheduling and to arrive on time for appointments.
Cancellations or rescheduling must be made at least 24 hours in advance, or you may be charged a cancellation fee, as outlined in our cancellation policy (available upon request).
c. Professional Advice
Our Services are provided by licensed professionals, such as physical therapists, in accordance with industry standards. However, health outcomes vary, and we cannot guarantee specific results. Always consult your healthcare provider before starting any new treatment or fitness program.
4. Payments and Fees
a. Service Fees
Fees for Services are provided at the time of booking or consultation. All payments must be made in full at the time of service via cash only.
b. No Insurance Payments
We do not accept insurance payments or process insurance claims. You are solely responsible for the full cost of all Services.
c. Refunds
Refunds for Services are issued at our discretion and in accordance with our refund policy (available upon request). No refunds are provided for missed appointments without proper cancellation notice.
5. Intellectual Property
All content on the Site, including text, images, logos, videos, and resources (e.g., exercise guides or blog posts), is owned by Radical Recovery & Performance or its licensors and protected by copyright, trademark, and other intellectual property laws. You may use Site content for personal, non-commercial purposes only. Any other use, including reproduction, distribution, or modification, requires our prior written consent.
6. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal and health information, including protected health information (PHI) under HIPAA, are governed by our Privacy Policy (available at https://radicalrecoverypt.com/privacy-policy). By using the Site or Services, you consent to our data practices as described in the Privacy Policy.
7. Disclaimers and Limitation of Liability

We do not guarantee that the Site will be uninterrupted, error-free, or free from viruses or other harmful components.
Information on the Site, such as health or fitness tips, is for general informational purposes only and not a substitute for professional medical advice.
b. Limitation of Liability
To the fullest extent permitted by law, Radical Recovery & Performance, its officers, employees, or agents will not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from your use of the Site or Services, even if advised of the possibility of such damages. Our total liability, if any, will not exceed the amount you paid for the specific Service giving rise to the claim.
8. Indemnification

10. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site or Services will be resolved through negotiation or, if necessary, in the state or federal courts located in Maricopa County, Arizona. You waive any objection to such jurisdiction or venue.
11. Force Majeure
We are not liable for delays or failures in providing the Site or Services due to events beyond our reasonable control, such as natural disasters, pandemics, government actions, or technical failures.
12. Miscellaneous
Entire Agreement: These Terms, along with our Privacy Policy and any other agreements you sign with us (e.g., client intake forms), constitute the entire agreement between you and Radical Recovery & Performance.
Severability: If any provision of these Terms is found invalid or unenforceable, the remaining provisions will remain in effect.
Waiver: Our failure to enforce any right or provision will not constitute a waiver of that right or provision.
Assignment: You may not assign your rights or obligations under these Terms without our consent. We may assign these Terms in connection with a business transfer.
